TERMS OF USE

Last updated: October 11, 2025

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE. THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

These Terms of Use (the “Terms”) constitute a legally binding agreement between you and Injured Cases LLC, doing business as Comp Claim Counsel (“Comp Claim Counsel,” the “Company,” “we,” “us,” or “our”), governing your access to and use of compclaimcounsel.com and any website, landing page, form, questionnaire, or other online property operated by the Company that links to these Terms (collectively, the “Site”), and the services offered through the Site, which consist of connecting consumers who have experienced workplace injuries with independent attorneys and legal marketing companies that may be able to assist them (the “Services”). By accessing or using the Site, submitting information through the Site, or clicking to accept these Terms, you accept and agree to be bound by these Terms and by our Privacy Policy and Legal Notice, each of which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site or submit any information to us. We may revise these Terms at any time by posting the revised Terms on the Site with an updated effective date, and your continued use of the Site following any such posting constitutes your acceptance of the revised Terms; you are responsible for reviewing these Terms periodically.

The Site and Services are offered and available only to individuals who are at least eighteen (18) years of age, who reside in the United States, and who are seeking information regarding a potential workers’ compensation claim on their own behalf or on behalf of a person for whom they are legally authorized to act. By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements, that the information you provide through the Site is true, accurate, current, and complete, that the information you provide relates to you or to a person on whose behalf you are legally authorized to act, and that you are not providing information regarding any other person without that person’s authorization. If you do not meet these requirements, you must not access or use the Site.

The Company is a legal marketing company. The Company is not a law firm, attorney, or lawyer referral service, does not provide legal advice, legal opinions, or legal representation, does not evaluate the merits of any claim, and is not bound by the professional responsibilities and duties applicable to attorneys. Nothing on the Site, and no communication between you and the Company, constitutes legal advice or creates an attorney-client relationship or any other professional relationship between you and the Company or between you and any attorney. An attorney-client relationship may be formed only upon execution of a written retainer or engagement agreement between you and a licensed attorney. Any information you transmit to the Company is not protected by the attorney-client privilege or any duty of confidentiality. The Services consist solely of advertising and the transmission of the information you submit to one participating attorney or legal marketing partner (each, a “Participant”), which may in turn provide such information to a law firm with which it works, so that the Participant or such law firm may contact you regarding potential legal assistance. Participants pay the Company for advertising and are not selected, screened, or recommended on the basis of any evaluation of their qualifications, and the Company makes no representation, warranty, or guarantee regarding the qualifications, experience, competence, licensure, or availability of any Participant or any law firm with which a Participant works. The Company does not guarantee that any Participant will contact you, that any attorney will review your matter or agree to represent you, that you have a valid claim, or that any particular result will be obtained. Any legal services provided to you will be provided solely by the attorney or law firm with which you enter into a written agreement, pursuant to the terms of that agreement, and the Company is not a party to, and has no responsibility or liability with respect to, any such agreement or any services provided thereunder. Statutes of limitation and other deadlines applicable to workers’ compensation claims vary by state and may be brief; the Company does not monitor or advise regarding any such deadline, and submission of information through the Site does not toll, satisfy, or otherwise affect any deadline, constitute the filing of any claim, or constitute notice to any employer, insurer, or governmental agency. Services may not be available in all states.

By submitting a form on the Site and checking the consent checkbox presented to you, you provide your electronic signature and your prior express written consent to be contacted by the Participant identified in the consent language displayed at the time of submission, by any law firm with which such Participant works, and by intake personnel acting on their behalf, at the telephone number and email address you provided, by telephone call, text message (SMS and MMS), and email, including calls and text messages made or sent using an automatic telephone dialing system, an artificial or prerecorded voice, or an artificial-intelligence-generated or synthetic voice, regardless of whether your telephone number is listed on any federal, state, or company-specific Do Not Call registry or list. You represent and warrant that you are the current subscriber or customary user of the telephone number you provided, that you are authorized to consent to receive communications at that number, and that you will promptly notify us at [email protected] if you cease to be the subscriber or customary user of that number. Consent is not a condition of purchasing any goods or services or of retaining any attorney. You may revoke your consent at any time and by any reasonable means, as described in our Privacy Policy. Message frequency varies, and message and data rates may apply. You agree that your electronic submission of a form on the Site, including your checking of a consent checkbox and clicking of a submit button, constitutes your electronic signature and has the same legal effect as a handwritten signature pursuant to the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) and applicable state law, and you consent to receive communications, notices, and disclosures from us electronically. You acknowledge that the Company uses lead-certification technology, including TrustedForm by ActiveProspect, to record your interaction with the Site and document your consent, and that the resulting record may be provided to the Participant that receives your information and may be used as evidence of your consent.

Unless otherwise indicated, the Site and all content, features, and functionality thereof, including all text, graphics, logos, images, video, audio, questionnaires, software, and the design, selection, and arrangement thereof (collectively, the “Content”), are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws. The names Comp Claim Counsel, the Comp Claim Counsel logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors, and you must not use such marks without our prior written permission. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content for your personal, non-commercial use in connection with seeking information regarding a potential workers’ compensation claim. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content, except as incidentally necessary to view the Site in your browser, and any use of the Site or Content not expressly permitted by these Terms is a breach of these Terms and may violate applicable law.

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates any applicable federal, state, local, or international law or regulation; to submit any information that is false, inaccurate, misleading, or fraudulent, or that relates to any person other than yourself without that person’s authorization; to submit any information for the purpose of testing, harvesting, or obtaining information about the Company, its Participants, or its systems; to impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity; to engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site or that, as determined by us, may harm the Company or users of the Site or expose them to liability; to use any robot, spider, scraper, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the Content; to introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful; to attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site; to attack the Site via a denial-of-service attack or a distributed denial-of-service attack; to frame or mirror any part of the Site without our prior written authorization; or otherwise to attempt to interfere with the proper working of the Site. We reserve the right to terminate or suspend your access to the Site, without notice and for any reason, including any violation of these Terms, and to take appropriate legal action, including referral to law enforcement, for any illegal or unauthorized use of the Site.

The Site may contain links to third-party websites and resources, including the websites of Participants, advertising platforms, and other third parties, that are provided for your convenience only. We have no control over the contents of those websites or resources, accept no responsibility for them or for any loss or damage that may arise from your use of them, and do not endorse them. If you decide to access any third-party website linked to the Site, you do so entirely at your own risk and subject to the terms and conditions and privacy policies of such website. Any dealings between you and any Participant, law firm, or other third party, including the negotiation and execution of any retainer or engagement agreement and the provision of any legal services, are solely between you and such third party, and you agree that the Company is not responsible or liable for any loss or damage of any kind incurred as a result of any such dealings.

THE SITE, THE CONTENT, AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ON BEHALF OF ITSELF AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS, DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, THE COMPANY MAKES NO WARRANTY OR REPRESENTATION THAT THE SITE, THE CONTENT, OR THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, THAT ANY PARTICIPANT OR ATTORNEY WILL CONTACT YOU OR AGREE TO REPRESENT YOU, THAT YOU HAVE A VALID OR VIABLE CLAIM, OR THAT ANY PARTICULAR RESULT, RECOVERY, OR OUTCOME WILL BE OBTAINED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE COMPANY OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING EXCLUSIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OR THEIR RESPECTIVE MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF USE, LOSS OF DATA, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR LOSS OR IMPAIRMENT OF ANY LEGAL CLAIM OR REMEDY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, THE CONTENT, OR THE SERVICES, ANY COMMUNICATION FROM OR DEALINGS WITH ANY PARTICIPANT, ATTORNEY, OR LAW FIRM, ANY LEGAL SERVICES PROVIDED OR NOT PROVIDED TO YOU, OR THE EXPIRATION OF ANY STATUTE OF LIMITATIONS OR OTHER DEADLINE, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE OR IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE COMPANY AND ITS AFFILIATES ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICES EXCEED ONE HUNDRED DOLLARS ($100.00). THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, IN WHICH CASE THE FOREGOING LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective members, managers, officers, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms, your use of the Site or the Services, any information you submit through the Site, including any inaccurate, incomplete, or unauthorized information, any breach of your representations and warranties set forth herein, including your representation that you are the subscriber or customary user of the telephone number you provided, or your violation of any law or the rights of any third party.

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services, including their formation, interpretation, breach, termination, or validity, and including any claim regarding communications made to you by any Participant (each, a “Dispute”), shall be governed by and construed in accordance with the laws of the State of Florida and the Federal Arbitration Act (9 U.S.C. § 1 et seq.), without regard to any choice or conflict of law provision or rule. Before initiating any arbitration or other proceeding, you agree to first send written notice of the Dispute to the Company at the address set forth below, describing the nature and basis of the Dispute and the relief sought, and to negotiate in good faith with the Company for a period of sixty (60) days following receipt of such notice in an effort to resolve the Dispute informally. If the Dispute is not resolved within such period, you and the Company agree that any Dispute shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect, before a single arbitrator, and that judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. The arbitrator, and not any court, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of it is void or voidable. The arbitration shall be conducted in Pinellas County, Florida, or, at your election, in the county in which you reside or by telephone or videoconference, and the AAA rules shall govern the payment of filing, administrative, and arbitrator fees, except that the Company will pay such fees to the extent required by the AAA rules or applicable law. YOU AND THE COMPANY EACH AGREE THAT ANY DISPUTE SHALL BE RESOLVED SOLELY ON AN INDIVIDUAL BASIS, AND THAT NEITHER YOU NOR THE COMPANY SHALL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY; THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING; AND YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO A JURY TRIAL. Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes within the jurisdiction of such court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights. You may opt out of this arbitration agreement by sending written notice of your decision to opt out to the address set forth below, or by email to [email protected] with the subject line “Arbitration Opt-Out,” within thirty (30) days after first submitting information through the Site, stating your name, the telephone number and email address you submitted, and a clear statement that you wish to opt out of arbitration; if you opt out, all other provisions of these Terms shall continue to apply, and any Dispute shall be brought exclusively in the state or federal courts located in Pinellas County, Florida, to whose personal jurisdiction you irrevocably submit. If the class action waiver set forth above is found to be unenforceable with respect to any claim, then the arbitration agreement shall be null and void with respect to such claim, and such claim shall proceed in court. Any Dispute must be commenced within one (1) year after the cause of action accrues, or it shall be permanently barred.

These Terms, together with the Privacy Policy and Legal Notice, constitute the sole and entire agreement between you and the Company regarding the Site and the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the same. If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions shall continue in full force and effect. No waiver by the Company of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. You may not assign these Terms or any of your rights or obligations hereunder without our prior written consent; we may assign these Terms without restriction. Sections of these Terms that by their nature should survive termination, including the provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, shall survive any termination of these Terms or of your access to the Site. Headings and captions, where used, are for convenience only. The Site is controlled and operated from the State of Florida, United States of America, and we make no representation that the Site or the Services are appropriate or available for use outside the United States.
